What Can Be Done About Careless Driving Ticket
Sometimes drivers are given careless driving tickets as opposed to a more direct infraction like speeding or illegal lane change. Some versions of this ticket are difficult to fight while others are easier to stand up against in court.
Careless driving tickets given for things like talking on a cellphone, texting, or accidents that you have caused are extremely difficult to fight because there is really no defence that can be used against them that’s going to work in court. These types of tickets are going to stand up in court.
One example of a careless driving ticket that you can beat in court is one that’s given for lane changes. The officer gives you a ticket for making a quick lane change without signaling. You may have in fact had to do a quick lane change because someone suddenly stopped in front of you or there was something in the road. It’s important to know what the officer’s vantage point was at the time they saw you make the infraction because from that vantage point they might not have seen what you saw.
If you do find out what the cop’s vantage point, you can make the argument that the lane change or whatever infraction was done for safety reasons. The officer is not trying to be mean or spiteful. It’s just from their point of view that you did something wrong.
Another careless driving ticket that can at least be reduced is when an officer pulls you over for speeding, but doesn’t give you a speeding citation but one for careless driving instead. What this means is that the officer is guessing that you were breaking the speed limit, but did not actually record the speed on radar so he or she fell back onto writing a ticket for careless driving.
If you were going significantly over the speed limit in reality, this can be hard to fight. If you were not going over the speed limit or were only going over a little, it can be argued that the officer did not actually record the speed and it’s just their opinion that you were going fast. This is especially a good argument if there was no one else on the road with you. This type of ticket can be thrown out of court because the evidence on the officer’s side is merely opinion where most speeding infractions are using radar as the proof you violated the law.
