Chicago Lidar Tickets Thrown Out of Court
If you live in Illinois, tickets measured by lidar are being thrown out if challenged.
The reason is this method of speed measurement, Lidar laser, has not been scientifically proven accurate in Illinois courts.
What this means is that none of the evidence is allowed in court. If that is the only device saying you are speeding, you won’t get a ticket.
There is a general principle to be aware of about this. Any jurisdiction, not just Chicago or Illinois, has rules about the devices that measure speed whether laser, lidar, radar, pacing, etc.
These devices have certain checks and rules on them to be admissible in court. The reason is that any reading on these devices are technically just hearsay until they are proven to be accurate.
Most places require the device to be calibrated and tested every few months. This paperwork is something that the officer is supposed to keep up to date and paperwork they should bring to court.
If you ask for it and it’s not there or not up to date, you can tell the judge that the readings from the device are not allowed in the court as evidence and it will be thrown out.
At that point ask the judge to dismiss the ticket since there is no proof against you. You win.
